CONTRACT OF AGREEMENT

This Employment Contract made on the 16th of April 2013 between ST ERMIN’S HOTEL as Employer and KHALIL NAIM GORGR HAWA as the EMPLOYEE is in accordance to the rules and policies of the governing board and management of ST ERMIN’S HOTEL.

The following terms applies to the contract:

APPOINTMENT LETTER

After our recruitment exercise, we found you qualified and fit to fill our vacant job position. Hence, we seek to employ your services as stated in the following terms and conditions.

JOB LOCATION AND DESCRIPTION

The job is at ST ERMIN’S HOTEL. You are to report to the HR Manager upon arrival for other logistics. Your duties will be explained and assigned to you on your arrival by your Head of Department.

WORK HOURS:

Employee official work hours run from Mondays through Fridays, Time: 8.00am to 5.00pm with break period of one hour only, beginning from 12.00noon to 1.00pm.

SALARY, ALLOWANCES & BENEFITS

BASIC MONTHLY SALARY: 3,800GBP (Three Thousand Eight Hundred British Pounds) a month. Salary shall be liable to Increments with time and employees' official promotions as judged by Employer. Any bonus or declarations of bonus shall be made at the sole and absolute discretion of the Hotel. Employee shall also be entitled to over-time allowance if their work time exceeds the official working hours.


JOB PROCEEDING

You will be expected to resume your job as a PUBLIC RELATION OFFICER at the ST ERMIN’S HOTEL on the 06th of May 2013. Work time shall be 44 hours a week (8hrs a day) for the four (4) years contract term. Contract renewal depends on Employee’s performance and Employer’s discretion.

PROBATION

The parties hereto agree that the initial two (2) month period of this agreement is "probationary" in the following respects:

a) The Employer shall have an opportunity to assess the performance, attitude, skills and other employment-related attributes and characteristics of the Employee;

b) The Employee shall have an opportunity to learn about both the Employer and the position of employment.

LEAVE PERIOD

You must notify the company and/or your immediate supervisor as soon as practicable if you are unable to work for medical reasons. Such notice shall be given within the first four
(4) hours of the working day.

Annual Leave: The Employee is entitled to six (6) weeks paid annual leave upon the completion of one year's service from the date of confirmation of your employment.

Sick Leave: The Employee shall be entitled to sick leave and emergency leave according to the regular policies and procedures of Hotel. Additional sick leave or emergency leave over and above paid leave provided by the Hotel, if any, shall be unpaid and shall be granted at the discretion of the board of directors.

FEEDING & ACCOMODATION

Employee is expected to reside at the ST ERMIN’S HOTEL. Family package status is available for employee that wishes to Re-locate with Family. Employee is entitled to take meals free of charge at the general staff canteens. Dietary options, customized cooks and dieticians are available options.

NOTE: The management of the ST ERMIN’S HOTEL is going to charge you for the payment of work permit and employee will also be charged for accommodation registration so that they can reside at the Hotel's housing estate.

MEDICAL EXPENSES

Employer will provide the employee with comprehensive health care for the term of contract, and follow-on care for injuries suffered during the term of contract for employee and family. Medical Insurance is free for the employee and the employee is entitled to travel and relocation allowance which must be paid by the employer before resumption of duty.

ADDITIONAL SERVICES

Recreational/Sports facilities shall be made available at the disposal of all employees with no expenses to be incurred. Laundry and dry cleaning service will be made available to employee by the Hotel’s laundry and dry cleaning unit on request.




TRAVEL PLANS/ RE-LOCATION

For Expatriates, Free UK flight ticket will be issued to the employee by the employer as soon as the employee sends copy of a UK work permit paper to the employer. This is in line with the expatriate statuary law of the UK in compliance with the U.N. Terrorism Act. However, for expatriate who do not have valid UK Visa and Work Permits Papers, are to make contact with our official travel agent here in UK for the procurement of Visa and Work Permit processing code and approval letter. It should be noted that your employer will take care of charges for your Visa, flight tickets and any other travel costs excluding the charges for a UK Work Permit Paper which should be taken care by employee.

All UK based employees' are to report personally to our office in London with their documents (including this contract document) for identification, signing, and collection of hard copy of their contract documents.

Note: The UK work permit is meant for Non-EU citizens only.

REIMBURSEMENTS AND EXPENSES

The Employer shall reimburse the Employee in full amount for all reasonable expenses incurred during the process of travel and procurement of immigration documents and any other required certification. Employee will maintain records and written receipt as required by the Hotel policy and reasonably requested by the board of directors to substantiate such expenses.

a) Expenses made by the Employee in relation to household equipment, pets, and other personal assets shall not be reimbursed as these would be considered employees responsibility.

b) Employee is strongly advised to keep original receipts and evidence of payment(s) made before arrival in the United Kingdom as reimbursement applications made without receipt or evidence of payment shall be denied.

c) Reimbursement shall be made to ONLY those who applied for them.




TERMINATION OF EMPLOYMENT

Subsequent to completion of the probationary term of employment referred to in paragraph 2 herein, the Employer may terminate the employment of the Employee at any time:

a) For just cause at common law, in which case the Employee is not entitled to any advance notice of termination or compensation in lieu of notice.

b) Without just cause, in which case the Employer shall provide the Employee with advance notice of termination or compensation in lieu of notice.


The Employee may terminate his employment at any time by providing the Employer with at least eight (8) weeks advance notice of his intention to resign.












AGREEMENT OF CONTRACT

This Agreement terminates and supersedes all prior understandings or agreements on the subject matter hereof. This Agreement may be modified only be a further writing that is duly executed by both parties. This Agreement shall be construed and enforced in accordance with the laws of the United Kingdom.

I regret to inform you that it's a standard scam written in a form that suggests that it's a scammer of West African origin who wrote it.

It's common that these scammers try to use a very polished style of English but then make very simple errors and mistakes, and they also make up things they don't know about UK employment and immigration law.

This passage of the letter is complete nonsense and it isn't possible for a travel agent to arrange a visa for you. You would have to apply at a UK Embassy in your own country and they will not issue a visa against copy passport documents. This is why you have to apply in person.

This is in line with the expatriate statuary law of the UK in compliance with the U.N. Terrorism Act. The scammer is lying and intends to ask you for money to supply a visa that it is impossible for him to arrange.

It is a scam. Remember, if it sounds too go to be true it is.

Wage works out at £45,600 a year and with free accommodation and food.
