The Job description


Our company provides interior and exterior design services. We work with independent designers. We have huge database of freelancers from Eastern Europe and Asia mainly. They offer perfect combination of affordable price and high quality. Considering the seriousness of the current situation in the US because of the recession (when people and companies reduce costs) our company has become very popular among our clients. Cheap prices attract new clients from other states.

Since we want to expand and we want to work in your state we need a Customer Service Manager, an individual who resides there and who will be able to perform certain functions for the company. Thus, we can reduce costs and again offer cheap prices to our clients. This is important for us because we will pay you a salary instead of spending money for the office rent and salary of the office manager. Therefore, you will work from home as independent contractor.

Another reason why we have the vacancy opened is time. Customer Service Position requires your full availability and mobility. We had small experience working without a Customer Service Manager, but received complaints from the clients. Since we are not physically present in your state we offered our clients to make payments directly to our freelances once the job was done. The clients did not like that idea because they had to spend 2-3 and sometimes 4 days to process payments. Here're the reasons why. We usually pay designers through Money gram or Wester Union(the fastest way to pay in cash). There're usually several designers working on the project. It takes time to get to the bank (traffic) and takes money (line). It takes time to get to Western Union (traffic) and send the money to every designer (line). The clients offered us to hire a Manager who could receive wire transfers and distribute the money between freelances. In that case we needed somebody who was in the same state. We do not want to lose our clients. On the contrary we want to improve our service.


Therefore, as a Customer Service Manager you need to have a bank account and correct home address to be able to receive wire transfers (cash) and package from the clients. Your responsibility is to withdraw that cash and send it through International Wire Transfer or Western Union or Money Gram to freelances.

You need to work though a regular checking account that you do NOT use. OR you can set up a brand new account in any Banks which located close of you. You will need to process the payments the same day and make reports for the clients for the completed deals. You will receive detailed instructions via email and over the phone as far as where, how much and how to send the money to.

You will be paid $3,000.00 per month on monthly basis and you will receive 5% commission from every completed payment. Besides, we cover incoming and outgoing transfer fees with every payment coming in.

Let me give you day-to-day duties and example of the payment process:
You should be on the phone from 8am through 6pm Mon-Fri. Whenever the client informs us that he made a wire transfer into your account we call you immediately. After that we send you instructions via email, you print it out or check it on your mobile phone, go to the bank, withdraw cash and send it through Western Union or Money Gram. Or you will send a international wire transfer in the case of A designer do not allow to accept Western Union or Money Gramm. You will have 2-3 transactions per week and can make up to $6,000.00 per month.

FOR EXAMPLE, today is your first transaction. The client sends $5,000.00. He informs us of that and we call you. We send you instructions via email and you check them. After that you come to the bank. Since we cover incoming fees you will leave $12 in the account (the bank will take it out automatically) and withdraw $4,988.00 in cash. You take your 5% - $ 250 and go to Western Union. When you come there you give $4,738.00 to the Western Union officer and tell him/her where and who to send the money to. They take their commission of $100.00 and give you a receipt with the details of the transaction. You send the copy to us or the client via fax or email.

In other words you receive commission after each payment and you will receive $3,000.00 in one month after your first transaction according to the agreement.

We do not work on bank holidays and weekends. We provide 30 days paid vacation per year. No other benefits. You will work as Independent Contractor (1099 Form).

The Contract
Customer Service Contractor Agreement
This Agreement (the “Agreement”) is made between 4 Construction, LLC (the “Company”) and Mr./Mrs. ________________________________, living at street address _________________________________, city _________________, state ________________, zip ____________, USA, date of birth ____________________, SSN _____-____-________, e-mail __________________________________, (the “Contractor”) (collectively referred to as the “Parties”).
The Parties agree as follows:
1. SERVICES. The Company shall engage the Contractor to provide the following services:
1.1. Accept payments from customers of the Company and transfer the payments to the Contractors of the Company who provide design and architectural services.
1.2. The Contractor acknowledges that the Company works with design and architectural companies and independent designers and architects who provide their services in different locations and different countries.
1.3. The Contractor acknowledges the all the transactions must be made the same day the money received if not required otherwise.
2. TERM.
2.1. The Contractor shall provide the services to the Company pursuant to this Agreement for a term beginning on “_____”___________________ 2013 and ending on “_____”__________________ 2014 (the “Agreement Term”).
3. GUIDELINES.
3.1. The Contractor will follow the guidelines provided by the Company that describe the method, details, and means of performing the Services.
3.2. The Guidelines are provided via e-mail to the e-mail address of the Contractor indicated above.
4. TELEPHONE.
4.1. The Contractor must always be available on the phone and be ready to receive the Guidelines within reasonable period of time.
4.2. The Company must always give a phone call before and upon sending the Guidelines to the Contractor.
4.3. The Contractor and the Company must always be available on the phone during the transaction starting from the moment when the notice about the transaction was made to the Contractor.
4.4. The Parties must always and immediately inform each other about any changes that may influence the transaction.
5. COMPENSATION.
5.1. For the services provided the Company will pay the Contractor a 5% commission from every successfully completed transaction.
5.1.1. The Contractor receives 5% commission for previously successfully completed payment into a bank account with the following payment and has the right to refuse processing the new payment if the Company does not pay for already completed payment.
5.2. Fixed salary of the Contractor is $ 3 000 per month on monthly basis:
5.2.1 The company is to pay the first month salary for $ 3 000 in 30 days after the first transaction is posted to the account of the Contractor.
5.2.2. All future month salaries are paid with an interval of 30 days.
5.2.3. All month salaries are done in check or wire form. The method of the payment is chosen by the Contractor.
5.3. The Company pays the additional $ 1 000 in every six months if all the payments were completed without any delays.
6. EXPENSES.
6.1. The Company is to cover the following expenses:
6.1. Gas expenses.
6.2. Wire transfer fee when money arrives to the bank account.
6.3. Taxes.
6.4. Taxi expenses if no other means are available to complete the transaction on time. The Contractor should immediately inform the Company of force-major.
6.5. Western Union and Money Gram transaction fees if this way of transfer takes place.
6.6. Wire transfer fee when making wire transfer.
7. INDEPENDENT CONTRACTOR.
7.1. The Contractor is an independent contractor and not an employee of the Company, and, unless otherwise stated in this Agreement, is not entitled to any of the benefits normally provided to the employees of the Company.
8. CONFIDENTIALITY.
8.1. The Contractor acknowledges that all the information that he/she receives during the Agreement Term is confidential and proprietary one. The Contractor agrees not to disclose to any other person (unless required by law) or use for personal gain any Confidential Information at any time during or after the Agreement Term, unless the Company grants written consent of such disclosure.
9. OTHER RULES AND POLICIES.
9.1. The Contractor agrees to abide by any other rules, policies and procedures as communicated by the Company.
9.2. The bank account of the Contractor can be used for the purposes of the business only.
9.3. The Contractor does not carry responsibility for the mistakes made in the guidelines and for the actions of third parties.
9.4. The Contractor acknowledges that the bank may apply standard procedures when receiving the money e.g. “holding” and/or “pending” and the Contractor will assist the Company in receiving this money. If this takes place the Contractor must provide bank account statement to the Company proving the money status.
9.5. The Company warrants that all funds received by the Contractor are earned, of legal origin, free of fraud, theft and misrepresentation.
10. TERMINATION.
10.1. This Agreement may be terminated for the following reasons:
10.1.1. By the Company
10.1.1.1. If the Contractor fails to perform his/her duties or materially breaches any obligation in the Agreement, and the failure or breach is not corrected within five days of receiving written notice from the Company; or
10.1.1.2. If the Contractor is unable to provide the services in this Agreement due to illness, death or disability.
10.1.2. By the Contractor
10.1.2.1. If the Company materially breaches any obligation in the Agreement and such breach is not corrected within five days of receiving written notice from the Contractor; or
10.1.2.2. If the Company files for bankruptcy.
11. RETURN OF PROPERTY.
11.1. Upon termination of the Agreement the Contractor will promptly return to the Company all drawings, documents and other tangible manifestations of Confidential Information (and all copies and reproductions thereof). In addition, the Contractor will return any other property belonging to the Company including without limitation: office supplies, money and documents except for the gifts and awards presented by the Company to the Contractor.
12. CONTINUING OBLIGATIONS.
12.1. Notwithstanding the termination of this Agreement for any reason, the provisions of the Clause 6 of this Agreement will continue in full force and effect following such termination.
13. BINDING EFFECT.
13.1. The covenants and conditions contained in the Agreement shall apply to and bind the Parties and the heirs, legal representatives, successors and permitted assigns of the Parties.
14. CUMULATIVE RIGHTS.
14.1. The Parties’ rights under this Agreement are cumulative, and shall not be construed as exclusive of each other unless otherwise required by the law.
15. WAIVER.
15.1. The failure of either party to enforce any provisions of this Agreement shall not be deemed a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.
16. SEVERABILITY.
16.1. If any part or parts of this Agreement shall be held unenforceable for any reason, the remainder of this Agreement shall continue in full force and effect. If any provision of this Agreement is deemed invalid or unenforceable by any court of competent jurisdiction, and if limiting such provision would make the provision valid, then such provision shall be deemed to be construed as so limited.
17. ACCOUNTING ASSISTANCE.
17.1. The Company is to provide accounting assistance for the Contractor basing on the information received through online access.
17.2. The company undertakes to keep an online access information strictly confidentially.
18. GOVERNING LAW: This Agreement shall be governed by and construed in accordance with the laws of the State where the Contractor is registered.

There is a legitimate construction company at 3922 Estepona Avenue in Miami-Dade County, Florida, but it does not appear to have a website. fl4construction.com was registered by someone in Salt Lake City, Pennsylvania, which is not anywhere near Florida. There is another fake site which HD found, innovatconstruction.com, which looks identical except for the name and contact info (Innovat has no address). Both claim the same projects, and both have been reported for fraud.

I got an email from them about 30 mins after I used a credit check website! Am wondering if the spam timing is accidental, coincidental, or a direct result of the credit website interaction! Since the email addressed me by name .. I'm not feeling coincidence here! Should I be filing a complaint with that website?
