HEREINAFTER REFERRED TO AS “BUYER”,
HEREINAFTER REFERRED TO AS “PARTIES”, HAVE MADE AND HAVE SIGNED THE PRESENT CONTRACT.
Both parties have agreed to sign this contract for : Sales and Purchase of : 01 EXOTIC FEMALE SAVANNAH CAT./KITTEN .
Under the terms and conditions as follows:
I/We ROBERT AND VASYLEVA Represented by Mr Nichols Robert. hereby agree to sell to XXX . As (Buyer) agree to buy One (01) Female F1 SAVANNAH KITTEN as describe below. The buyer on his/her part has agreed to buy One (01) Female F1 Savannah KITTEN for the Purchase Price named below, under the terms with Guarantee in this Agreement and described as follows:

TOTAL PURCHASE PRICE US$ 3500 (THREE THOUSAND FIVE HUNDRED US DOLLARS)
The purchase Amount for surety of purchase is Approved paid against this Agreement as to guarantee Seller will hold the Kitten for delivery to the Buyer on the below specified Delivery:

PURCHASE SURETY:
Surety of Action on Purchase in the amount of ( US$ 3500) Three Thousand Five Hundred US Dollars (As the Purchase Price) is required for the purchase and sales confirmation ,and is to be completely paid Via Bank Transfer, Western Union or MoneyGram Wire Transfer, within 42 Hours after reception of the kitten’s Sales and Purchase Approved Signed Contract . A deposit of $1750 USD ( One Thousand Seven Hundred and Fifty US Dollars) has to be paid and the other balance completed after delivery). Delivery Freight ticket and shipping documents for finality purchase and sales of the cat/kitten are forwarded by Email accompanying the kitten shipment required folder.
There are refunds on Payments, unless otherwise agreed in writing. Failure of the Buyer to complete this purchase would subject Seller to lost opportunities to sell the Kitten to some other Buyer and 10% retention of the Deposited Amount is meant to compensate Seller for his possible loss. This signifies the intent on the part of the Buyer to follow through with the Purchase of this Kitten. The Seller reserves the right to void this transaction and refund the Payment if they learn of any reason why Buyer might not be suitable for the kitten. (Example: Buyer is found to be an animal abuser, violent person, representative of a Pet Store, representative of a pharmaceutical research laboratory etc.) . If the transaction is voided or if through some tragic accident the kitten is to die or otherwise be seriously injured before it goes to its new home then, of course, the payment will be returned to the Buyer; unless the Buyer wishes to apply the payment to another Kitten, if one is available, or to a kitten from the next available litter.
HEALTH GUARANTEE
The Seller, Mr Nichols Robert , guarantees Kitten(s) to be free from infectious diseases for four(4) days after the Kitten(s) leaves their premises and guarantees the Kitten(s) to be free from genetic problems for up to one year of age. Hip and joint problems can be caused by or influenced by overfeeding, improper diet, failure to maintain proper weight, failure to provide sufficient exercise, over-exercising or improper exercising which would be out of our control. Seller will provide Buyer with a kitten that leaves the cattery; in good general health and that has known no physical defects. De-worming and first immunizations will have been completed. Buyer agrees that he/she will take their kitten(s) to their veterinarian within four(4) days of receiving the kitten for examination, testing for worms, treatment for worms, obtain prescription for Heartgard and Frontine (As recommended by vets).
Failure to have the kitten(s) examined by a vet within four(4) days of the date the kitten is delivered to Buyer or if Buyer fails to provide required that this health guarantee will be void.
RIGHT OF RECOVERY OR PLACEMENT
Should the Buyer find themselves unexpectedly in a circumstance where other things prevents them from being able to properly care for the kitten/cat, Buyer agrees that we will be contacted first and given first rights to the kitten. If the cat is to be sold, Seller will be given right of first refusal. Buyer agrees that the kitten will NOT under any circumstances be placed in an animal shelter or pound or rescue center. This provision is to ensure that the kitten will not end up homeless or destroyed.
GENERAL
This written Agreement contains all of the terms of this Kitten Deposit and Sales Agreement. Refunds are given, all deposits are refundable and all sales are final.To ensure that the Buyer can immediately reserve the Kitten of their choice, Buyer and Seller agree that this Agreement is in full force by virtue of E-mail exchange of completed copy of this agreement between Seller and Buyer. All disputes are subject to resolution with the Seller.
