Room for Rent and other rental scams

This weekend my wife got almost scammed for a rental in the Netherlands.

Are you okay with the contract,if so then we should proceed.I did hear words from my bank and i was told to come over for some updating.This snow here wont allow me to go out of this house and i already started my break here.I want you to do me a favour,i want you to please transfer the money to me through western union because i have its center just in front of my house and to be honest with you,i need the cash.I can not be able to go to my bank for now and there are tons of things i need to do.Like the posting of the keys is gonna require money and all.I will really appreciate it if you can do this for me and present me the payment receipt as an evidence of payment.My details is in the contract you have at hand.Upon receiving the payment receipt,i will update you on the exact time i will post you the keys but it wont be more than friday.I look forward to hearing from you.

3. PREMISES: The location of the apartment is 37 Amstel 1011 Amsterdam,Netherlands.The apartment being rented out by the Landlord of the apartment to the above named tenant who is liable to use the apartment and use the following facilities: wireless internet facilities, phone, microwave, dish washer, washing machine, dryer, refrigerator, bathroom, toilet, bedroom, kitchen and utility room.

5. RENT PAYMENTS: The rent is 500eur per calendar month for the whole apartment..


6. AGREEMENT TERMINATION: The tenancy agreement will be terminated by the landlord unless the landlord and tenant agrees otherwise that there shall be no holding over under the terms of this rental agreement.Upon termination, the tenant shall give the landlord all the possessions of the apartment and return the keys of the premises and remove all personal possessions.

7. UTILITIES: Includes the rent.

8. PROPERTY CONDITION: Tenant agrees to surrender and deliver to the landlord the apartment and all furniture within the premises. These properties must be in a good condition as they were at the beginning of the term, reasonable wear and tear excepted. The tenant will be held responsible for any damages beyond reasonable wear and tear occurring to the apartment.

9. SECURITY DEPOSIT: Tenant agrees to pay landlord a deposit of 500eur to cover damages beyond normal wear and tear. Landlord agrees to return the security deposit to the tenant while moving out of the apartment provided there are no damages caused which is beyond normal wear and tear.

10. ORIGINAL LEASE: This agreement is subject to the master lease between the landlord and his/her tenant.

11. OTHER TERMS AND CONDITIONS:

(a) Peaceful enjoyment: The tenant wishes to peacefully occupy the apartment during the term of this agreement. The tenant agrees that their respective invited guests will not
i. Commit any act, which will result in serious disruption of the right to peace of the neighborhood.
ii. Cause or allow invited guests to cause a nuisance.
iii. Commit any form of harassment on the grounds of race, color, religion, sex, sexual orientation, age or disability which may interfere with the peace and comfort of, or cause offence to the members of the neighborhood.
iv. Play any sound system so loudly that it causes a nuisance or annoyance to the neighborhood.
(b) Use of apartment: The tenant agrees to use the apartment for residential purpose and not to operate a business at the apartment or to use the apartment for any illegal purpose.
(c) Pets: The tenant agrees not to keep any animals on the apartment without the prior written permission of the landlord.

12. SOLE AGREEMENT: The parties hereby agrees that this document contains the entire agreement between the parties and this agreement shall not be modified, changed, altered or amended in any way except through a written amendment signed legally. (Any oral representations made at the time of executing this rent are not legally valid and therefore are not binding upon either party).
13. GOVERNING LAW. This Agreement shall be governed, constructed and interpreted by and under the Netherland’s law.

14. CONSTRUCTION: The words "Landlord" and "tenant" as used herein include the plural as well as the singular. The pronouns used herein shall include, where appropriate, either gender or both singular and plural.

15. ACKNOWLEDGEMENT OF COPY RECEIVED: Each party signing this rental agreement accepts a copy thereof.

16. PAYMENT: The tenant will pay a month rent and security deposit in advance to the landlord before moving in to show a good sign of seriousness and the security deposit shall be refunded back to the tenant on termination of the agreement.
17. Clause: The tenant shall be giving a grace to return the keys of the apartment if the described condition of the apartment was not met after possession of the keys and movement to the apartment. There shall be no penalty for this act.

18. GUARANTEE: A guarantee of receipt shall be issued out for the tenant for the payment and it will be attached to a copy of the tenancy rental agreement form and the tenant must bring a copy of the rental agreement form and a copy of the receipt when moving in to the landlord's apartment.

LAWYER’s DECLARATION.
I, Barrister Peter Louise hereby give my consent as lawyer to witness the above described apartment as set out in this rental agreement. I also give witness that payment was made and a receipt shall be issued to the tenant no later than 48 hours.

Thank you for posting this information portwally and welcome to ScamWarners. Unfortuantely, scammers keep popping up. Some times it is the same scammer and some times it is another scammer using the same script. As long as they can steal money this way, they will keep doing it. Thank you for helping to make it more difficult for them to take money from others.

He almost caught me out too today. I'm just glad i googled 'Barrister Peter Louise before I signed his contract and transferred money in advance. This time he was masquerading as David Morris Kelly, [email protected], but with an identical contract to the one posted here. When something appears to good to be true it probably is...and this is!! I lived in Amsterdam for over 10 years and know 500 Euros for an apartment on Amstel is unheard of. Oh, and free parking space too...you'd be lucky!!!!

Furthermore they request the prepayment through Western Union using some cheap excuses.

Be warned when listening of Western Union transfers.

I have to say, Google does save lives or at least someone's money. This time it was a flat for rent in Finland and my friend was about to get scammed. Today she asked me to help to translate an e-mail (her English language skills are even weaker than mine). I knew she was going to rent a flat but didn't know any details, just that the rent was pretty cheap and the person renting the place didn't speak any Finnish. Anyway, I read the mail and got suspicious. First because of some very strange ways to use English and then -when I had read a bit further- because the money was asked to send through Western Union. Then I googled the address that was given for the money transfer and found this website and the e-mail that was almost 100% identical to the one sent to my friend. My friend has apparently already sent her detailed information but not the money, as what I read from the e-mail concerned about signing the contract and sending the money.

I still don't know the name nor the e-mail address of the sender (as I only read the copy of the message), asked those from my friend but she hasn't replied yet.
