Room for Rent and other rental scams

Hey,

I just nearly stepped into the trap. Fortunately I found that board before making any payments. Unfortunately I yet have sended personal details to that guy.

It was a very nice offer for a sublease in Berlin, Prenzlauer Berg, Raumerstraße, found on http://www.studenten-wg.de.

After a little email and later skype conversation, the "Landlord" Peter, sent me the following contract:

Germany, Berlin Tenancy / Rental Agreement Form.

The Landlord agrees to rent, and the tenant agrees to take the premises described below. Both parties agree to keep, perform, and fulfill the promises, conditions and agreements expressed below:

1. Landlord: The Landlord is Peter Kelly Sadewater of Reichenberger Str. 133 10999 Berlin Kreuzberg, holder of passport Number: 250921570.
Date of Birth: 18/11/1965.

2. TENANT: The Tenant is xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx

3. PREMISES: The location of the premises is Raumerstr 22 10437 Berlin Prenzlauer Berg The premises being rent out by the Landlord of the apartment to above name tenant in use of the apartment and use of the following facilities: A Bedroom,Wireless internet facilities, Phone, Microwave, Dish washer, washing machine, Dryer, Refrigerator, Private Bathroom and Toilet, Living room, kitchen, utility room.

4. TERM: This Rent begins from 01.06.2011,and ends by 31.07.2011

5. RENT PAYMENTS: The rent is 350euro per month for the Bedroom in apartment.


6. AGREEMENT TERMINATION: The Tenant agreement will terminate by 31.07.2011Unless the Landlord and Tenant otherwise agree, there shall be no holding over under the terms of this Rental agreement. Upon termination, Tenant, shall give Landlord possession and return the keys of the premises and remove all personal possessions and rubbish.

7. UTILITIES: includes the rent.

8. PROPERTY CONDITION: Tenant agrees to surrender and deliver to the Landlord the premises and all furniture and decorations within the premises in as good a condition as they were at the beginning of the term, reasonable wear and tear excepted. The Tenant will be liable to the Landlord for any damages, reasonable wear and tear accepted, occurring to the premises or the contents thereof, which are caused by the Tenant or her guest.

9. SECURITY DEPOSIT: Tenant agrees to pay Landlord a deposit of 600euro to cover damages beyond normal wear and tear. Landlord agrees that if the premises and contents thereof are returned to her in the same condition as when received by the Tenant, reasonable wear and tear thereof excepted, he will refund to the Tenant 600euro at the end of the term.

10. ORIGINAL LEASE: This agreement is subject to the Master Lease between the Landlord and his Tenant.

11. OTHER TERMS AND CONDITIONS:

(a) Peaceful enjoyment: The tenant wishes to peacefully occupy the premises during the term of this agreement. The tenant agrees they and their respective invited visitors will not
i. Commit any act, which results in serious disruption of the rights of each to peacefully occupy the premises
ii. Commit any act, which results in physical harm to the parties, a member of her household, visitors or neighbors
iii. Cause or allow invited visitors to cause a nuisance.
iv. Commit any form of harassment on the grounds of race, color, religion, sex, sexual orientation, age or disability, which may interfere with the peace and comfort of, or cause offense to, each other, a member of her household, visitors or neighbors
v. Play or allow to be played any radio, television, record or tape recording or musical instrument so loudly that it causes a nuisance or annoyance to the other party.
(b) Use of Premises: The Tenant agrees to use the premises for residential purposes and not to operate a business at the premises nor to use the premises for any illegal purposes.
(c) Access: The Tenant agrees to allow the Landlord’s agent or contractors acting on behalf of the Landlord’s access at all reasonable hours of the daytime to inspect the condition of the premises or to carry out repairs or other works to the premises.
(d) Pets: The Landlord permits the tenants to bring in pet into the premises of the apartment.

12. SOLE AGREEMENT: The parties hereby agree that this document contains the entire agreement between the parties and this Agreement shall not be modified, changed, altered or amended in any way except through a written amendment signed by all of the parties hereto. (Any oral representations made at the time of executing this lease are not legally valid, and therefore, are not binding upon either party).
13. GOVERNING LAW. This Agreement shall be governed, constructed and interpreted by, through and under the German’s Law.

14. CONSTRUCTION: The words "Landlord" and "tenant" as used herein include the plural as well as the singular. The pronouns used herein shall include, where appropriate, either gender or both singular and plural.

15. ACKNOWLEDGEMENT OF COPY RECEIVED: Each party signing this rental acknowledges receipt of a copy thereof.

16. PAYMENT: The Tenant will pay a month Rent and Security Deposit in advance to the Landlord via Western union Money Transfer before moving in to show a good signs of seriousness and the Security Deposit will be refundable back to the Tenant.

17. GUARANTEE: A guarantee of Receipt will be issued out for the tenant for the payment and that will be attached to a copy of the Tenancy Rental Agreement Form and the tenant must bring a copy of the Rental Agreement Form and a copy of the guarantee of payment receipt when moving in to the Landlord's Apartment.

I, Peter Kelly Sadewater hereby gives my consent as Landlord to letting of the above described premises as set out in this Lease/Tenancy Rental Agreement Form.

This is a statement made by Louise Peter to assure complete safety of return of transferred funds in case this roommate agreement does not come to pass .The return of funds must be completed not later than 2 days of xxxxx xxxxx‘s arrival.




He wanted me to send him the money via Western Union, afterwards he would send me the keys to the apartment.

Make sure you get back to me with the senders name, senders address,
exact amount sent and the 10 digits MTCN. Once i receive
the payment confirmation from you, i will go ahead with the shipment
as soon as possible.


If I would have sent him the money, it was gone. I'm glad that the guy at the bank's office advised my on the phone to gather seriously for information, because that method is known for fraud.

The guy called himsel Peter Kelly Sadewater and his email was [email protected].

His adress shall be "7 Victoria rd, Brighton, BN1 3 FS, UK"

I hope I can help preventing somebody from being cheated by submitting that.
