WHO IS A MIGRANT WORKER?
Article 2, Para. 1 of the International convention of the protection of the rights of All migrant workers and members of their families, defines a “Migrant Worker’’ as a person who is to be engaged, is engaged or has been engaged in a remunerated activity in a state of which he or she is not a national.’’ Art.3 excludes the application of the term to persons sent or employed by a state other than that of which they are nationals; students and trainees; and sea fares and workers on offshore installations who have not been admitted to take up residence and engage in a remunerated activity in the state of employment.

RIGHTS OF MIGRANT WORKERS
Migration is, arguable a social phenomenon that is the natural result of human nature. Human beings have always moved from place to place in search of better occupational opportunities. But natural as this social phenomenon is, migrant workers have always been aliens in the new lands they have found to work in a and it is common place for these foreigners only to find themselves subject to marginalisation and/or exclusion from the various spheres of social like in these communities. Not only do migrant workers find themselves the least-favoured groups in the field of employment as different standards of employment are applied to them. Migrant workers often find themselves the target of suspicion and hostility that may result arbitrary expulsion and involuntary return. Recent trends of xenophobia and racist have emerged to threaten further, the social well-being of migrant workers.

According to your mail, your employer Dr. Jayson Mansfield sent me an email earlier telling me he has employed you to be his aupair and he want me to help you with your request of getting your Contract Letter and Invitation Letter. I am a busy Lawyer but I am willing to help you get these documents due to my personal relationship with Mr. Mansfield. Attached to this mail is a specimen of the Contract letter, I want you to fill it and sign it. This contract letter will guide you during your stay in Canada as it will give you legal backings in case your employer defaults in his responsibility as your employer. As for your Invitation letter I will draft it for you at the Court as soon as I get your signed Contract Letter as an evidence that you have accepted all the terms and condition of Mr. Mansfield. As for the legal fee for drafting these documents, the Contract Letter will cost hundred pounds, while that of the Invitation letter will cost fifty pounds, and also the shipping of the original documents to your doors step through DHL courier service will cost another fifty pounds which includes tax. In Total it will cost you two hundred pounds to get these documents, it will be ready in the next 48 days and sent to you. 4. Job Procedures. Mr. Mansfield. The Employee will devote full attention, honesty and hard work to the Job. Employee is not prohibited from making personal investments in any other businesses provided those investments is not illegal.

5. Reimbursement of expenses. The Employee may incur reasonable expenses for furthering the Job, including expenses for entertainment, travel, and similar items. Mr. Mansfield shall reimburse Employee for all business expenses after the Employee presents an itemized account of expenditures.

6. Off Days. The Employee will be off on weekends, Holidays, and the Employee gets one month of vacation of 6months of working.

7. This Contract sets out the terms and conditions of employment which are required to be given to the Employee under section 1 of the Employment Rights Act 1996.
