I too have had troubles with Petfood247.com.au. I really wish I'd read reviews before buying from them, will know to do that before buying from an internet site in the future.

I ordered my stuff (thankfully only $103) 4 Dec 2010 and the first email I sent was on 24 Dec followed by another couple of emails with no response. I then googled and found all sorts of bad reviews on this company and have now contacted my credit card company and lodged a transaction in dispute claim of the money I paid. The money has been refunded to my credit card but the company has 45 days to respond, so here's hoping that they don't as per usual otherwise I will be charged again.

All I can say is don't use this company and if you already have and haven't received your goods then I would contact your credit card company and have the transaction reversed.

What number did you use? All the numbers I have used do not go through. I'd appreciate if you would mind sharing the number so we can also speak to Gary to get our order sent. However - let us know if you really DO get your order or if it is another false promise of his! Keep us posted and please share the number with us.

Gary sent an email this morning to say that my order has been despatched so I am hopeful it will arrive. When I rang It was about 5.30 at night and just asked if that was Gary,( I was friendly) I said I had ordered & I was worried that it may not arrive because I had read some bad stuff about the company on the internet. He asked for my order number & then said I would receive it on Thursday. I asked if the company had been having problems and he said "I have not been working for a couple of months but I am back now"...or words to that effect. So I just thanked him & hung up.
The number I got him on was 0295437818
I will let you know if my order does arrive.

Woohoo!!! It did arrive on Thursday phew -that's a relief. I want to thank the people on this site for supplying me with his home phone and I hope others will be reimbursed if their orders don't arrive. Thanks everyone.

@ APPRENTICEGNOME,
That sounds like his standard course of action. "Smoke-blowing 101".
I ordered in early November and didn't get mine until a short time ago (after a lot of emails, phone calls and filing a number of complaints). The order must have been "lost", so he supposedly sent out a "replacement" order, which I got within a couple of days of receiving the "replacement" notice/email.

He's just trying to cover his @$$, which I would say is probably getting more difficult to do without actually just sending people their orders to begin with.

If the orders were really going missing, I guarantee that the delivery company would be in deep "doo" and Mr. McDuff would probably be out of business already due to the cost of all of these "replacement" orders.

Right now, he's likely doing what he has to do in order to get all of these people and agencies off his back.

There is no doubt in my mind that he deliberately operates just enough inside legal margins to be able to get by with what he does. He is purposely trying to create "reasonable doubt" so as to show it could be just "bad customer service" and not out-and-out fraud.

He is making a living out of being a "just a poor old guy that can't run a business very well", when in actuality, he know exactly what he's doing and just how much he can get away with.

Keep the pressure on and keep spreading the word!

After 2 wks, I contacted the company every day (emails and phone calls to the mobile). I was able to leave a message a couple of times, but mostly it was full. Every day I would make a complaint to various organisations: Fair Trading, my bank, Google and other places I saw this company's ad. Every day I emailed the co. and told them who I had contacted. Evenually I finally received my order.....3 & 1/2 wks after ordering them. I guess persistence paid off in the end.

MIRACLE OF MIRACLESMY ORDER ARRIVED THIS MORNING AND PRODUCT APPEARS TO BE IN DATE. NOT SURE IF IT WAS DUE TO THE PHONE CALL TO GARRY THE OTHER DAY OR IF VISA CONTACTING HIM THAT DID THE TRICK. CHALK IT UP TO LESSON LEARNED, I WILL DEAL WITH THE ONLINE SHOP I USED PREVIOUSLYON 2 OTHER OCCASIONS. A COUPLE OF DOLLARS MORE BUT WORKS OUT THE SAME WHEN YOU FACTOR IN PHONE CALLS TO GARRY AND VISA. BEST OF LUCK TO OTHERS GOING THROUGH THIS PROBLEM, PERSISTANCE WINS IN THE END AND GOOD LUCK TO THE PERSON TAKING HIM THROUGH THE TRIBUNAL TOMORROW. I SEE SOME PEOPLE WHO END UP RECEIVING THIER GOODS EVENTUALLY THINK THAT IT MAY BE JUST BAD SERVICE OTHER THAN A SCAM BUT I WONDER WHAT HAPPENS TO THOSE WHO DON'T PURSUE. IT SEEMS A BIT LIKE IT MAY BE A POSSIBLE LIMMITED RISK SCAM WHERE THE PERSON SCAMMING PREYS ON THOSE TO LAZY TO PURSUE OR WHO ARE NOT VIGILANT ON THIER PURCHASES. THIS LIMITS THE RISK OF LEGAL REPERCUSSION BY APPEASING THOSE WHO MAKE NOISE.

I wish I'd known about these peeps BEFORE I ordered from them! So here's my story.....

15th October 2010 - Order placed.
1st November 2010 - Contacted Petfood247 to find out when the order would be shipped, no reply shipped, no reply received.
8th November 2010 - Contacted Petfood247 for the 2nd time to find out when the order would be shipped, no reply received.
15th November 2010 - Contacted Petfood247 for the 3rd time to find out when the order would be shipped, no reply received. I then rang the mobile number given on your website several times that day to find that each time the mailbox was full and that I couldn't leave a message.
15th November 2010 - Complaint lodged with NSW Fair Trading - advised to contact credit card company.
15th November 2010 - Credit card company contacted.
15th November 2010 - Contacted Petfood247 to advise that I had contacted Fair Trading and the visa dispute office at my credit card company for a full refund for goods paid for, but not recieved.
16th November 2010 - Order receipt notification received from yourselves.
16th November 2010 - Reply to yourselves sent to say that the order had been cancelled and that I had contacted both Fair Trading and my CC company (second time)
18th November 2010 - Notification of shipping received from yourselves (reply sent by me to say that the order had been cancelled).

Today I received this email:-

Without Prejudice

Dear

Our previous letter has gone unanswered regarding the supply and subsequent chargeback of your order.Your order was delivered by Australia Post.

Therefore if payment is not deposited into our bank account by 11.00 Friday 18th February 2011 we will be lodging a statement of claim with Sutherland District Court for the order value of $417.68 plus all legal fees that we will incur.
Again our bank account details are:
Name : WWW PETFOOD247 COM AU
Bank: St George
BSB: 112-879
Account Number: 456234091

Sincerely

Liz - Accounts

No order has actually been sent, nothing signed for, nada!

16th Feb - contacted CC company contacted, Petfood247 are out of their dispute period of 45 days, which was up 1st Jan, so they cannot force us to pay for something we haven't received.
16th Feb - contacted NSW Fair Trading again and they advised to apply a CTTT do not have to pay order (anyone know about these?)

I've just fired back an email to Petfood427 stating a list of contact (as above) and have told them "I look forward to hearing back from you by return that you are closing the case". I have also said that if they're disputing delivery of goods, the they need to provide POD.

Cheeky wotsits!

Cheers,

Sara

@ Feenybeast ,

I'm pretty sure you are on safe ground WRT any action they may threaten.
I'm not sure what the CTTT could do on your behalf at this point anyway, since you got your money back from your credit card company.

What has most likely happened, is that because he failed to provide proof of delivery to the credit card company within the allotted time, a bad "mark" was recorded against their company which can result in their loss of ability to conduct transactions by credit card.

That is why they are "huffing and puffing" at you.
They stand to lose a lot more than a few hundred dollars on this one!

He would be opening a serious can of worms on himself if he tried to pursue any legal action against you to pay for something you never received. But then, he knows that and I'm betting he won't follow through.

In fact, if you get a summons, let me know. I will fly down and come to the hearing myself to lend you support. I would LOVE to be part of this!!!

Through the Freedom of Information Act, all of the complaints made with the various government agencies can be brought into evidence. This is why it has been so important for people to lodge those complaints.

I'm also betting we could get a few other victims together to come to the hearing, and depositions from others about this guy.

He doesn't stand a "snowball's chance"!

I think NSWFT's idea behind it was that if I lodged the CTTT I could stop them from attempting to claim back any monies, but as they can't prove delivery they haven't got a leg to stand on.

The lady at our CC bank said she'd had so many customers having problems with these peeps, especially over the last 4 months and was in the process of dealing with a new case today.

Thanks for replying and if I do get a summons, I shall let you know!

Cheers,

Sara

Please don't ring Gary tomorrow. He will be otherwise engaged. :D

If Gary couldn't resist the chargeback from the card company, he'll find it even harder to persuade a court, and it won't help that his case failed with them, and his record of unhappy customers isn't going to help.

I take no pleasure in his situation, but it's consumers who are suffering and unhappy, along with their pets, and it's not a viable business to make every customer you get, promise never to deal with you again.

I would LOVE to be at the hearing on 2 March!!!

It is shown to be at
Consumer, Trader and Tenancy Tribunal of NSW
HURSTVILLE:
Wednesday, 2 Mar 2011
2:15 PM at Hearing Room 2 Floor 3, 4-8 Woodville Street Hurstville NSW

Unless I'm mistaken, the person showing on the docket against Mr. McDuff appears to be a positively noted person in the community. (It might or might not be the same person found in the Sydney area using a quick Google search.)

If anyone can, please go down to the Tribunal and show your support.
Maybe someone can get more info on Mr. McDuff, and even a photo to share with us all!

If somebody knows her, see if you can get her to post her experiences here and/or on Facebook!

Actually JanH, I saw another name as the complainant but decided that it was not proper to name her here without her consent. Maybe it's more than one case.

Looking at her background I suspect that she will be quite formidable.

@ GomerPyle,

Yes, there was a case listed for yesterday, Wednesday, 16 February. That's the first one I reported, but I didn't note the name.

I did check the docket number, though, and they do appear to be 2 separate cases.

Hopefully, we will continue to see petfood247 appear on the hearing list more often now!

I hope someone thinks to request a list of all of the complaints against petfood247 from the government agencies under the Freedom of Information Act to present along with their other evidence.
There are details on each site as to how to do this.

I only mentioned the person's name in hopes that someone on the forum knows her and can contact her to show their support and to let her know that there are others out here, at least some of which willing to help in what ever way we can.

I am hoping that at least a few people can go to the hearing as a show of support and strength, and to see what other bits of information they can get that might help themselves and others.

I too have had a simliar experience to all. I ordered once & received the item in a timley manner. I then ordered some Frontline for my dogs & after 3 weeks I did not receive any products. I rang his mobile on several occasions & sent 3 emails to no avail. I then did a search through various sites & found he was dodgy. I contacted my credit card company to lodge a dispute though one of my searches led me to this site & a post from maccanh. When I rang It was about 12.30pm and I just asked if that was Gary, I was friendly as maccanh said to be. I said I had ordered & I was worried that it may not arrive because I had read some bad stuff about the company on the internet. I said I do not want to be another that will complain to ASIC or ACCC. He asked for my order number & then said I would receive it on Thursday, I just thanked him & hung up. I was not surprised when the order did not arrive on Thursday so I called again on Friday 18th Feb around 12.00pm & spoke to Gary, he advised it had been sent by courier so I aked him for the consinement number if which he provided. I rang the courier company & they said it was picked up & would be delivered. To my surprise it was delivered. The number I got him on was 02 9543 7818 I have noted another person has had similar succes using this number. Gary McDuff is a dodgy scammer & suggest anyone reading this who has not received there goods calls him continuously until you get what you paid for. If eveyone calls 02 9543 7818 perhaps he might get the idea.
