PROCEDURES
1. Lessor and Lessee sign the Deed of Agreement, which thereby automatically becomes a full recourse commercial contract after the Lessor has accepted Lessee’s application.
2. The bank of the Lessor will issue an MT-199 Pre-Advice message to the receiving bank. Lessor sends copy of the MT-199 to the Lessee within Twenty-Four Hours.
3. Within two (2) banking days of the receipt of the Lessor above MT-199 pre-advice, the bank of Lessee will send by SWIFT MT-799 a Bank Payment Undertaking (Exhibit B) confirming to receive and engage to pay the total amount up to 10%+2% of the total face value of the instrument which will include all charges and commissions.
4. Within two (2) banking days of Lessor receiving the BPU from the Receiving bank ,Lessor Bank shall send the SBLC by MT-760.
5. The Lessee’s bank receives, confirms and verifies the MT760 (SBLC); The Lessee then pays within Seven (7) Banking days to Sender the balance up to 10% to Senders nominated account. Lessee also pays the additional 2% agent/ brokers commission fees to agents/brokers. (Should Lessee default to pay the fees to the Sender and the Intermediaries fees as agreed on this DOA within allowed number of days after receipt of Swift MT-760, Lessor shall instruct the issuing bank to put a claim on the SBLC thereby forcing the Lessee's bankers to return the swift MT-760 (SBLC) to the issuing Bank.)
6. Within Seven (7) banking days after receiving all fees; Hard copy will be sent to Lessee bank by bank-bonded courier.
7. This Deed of Agreement is a full recourse commercial commitment governed by the Law of the jurisdiction that both parties reside and standards under ICC Regulation.
